Declaration of Dominant Operators
in the Nigerian Telecommunications Market
The Nigerian Communication Commission, in exercise of its regulatory
functions, has initiated a study on the declaration of dominant
operators within the telecommunications industry.
Due to the phenomenal
growth and ever changing dynamics of the Nigerian communications market,
the determination of dominant operators in the specific telecoms markets
has become imperative. The Commission has appointed the consulting firms
of McCarthy Tetrault, LLP and D. D. Dodo & Co as consultants on this
project.
In undertaking this
project, the Commission will carry out evaluations and analysis of
specific telecommunications markets, identify the dominant operators in
these markets and identify conducts or behaviors in these markets that
may substantially affect competition. Specific markets will be
identified and evaluated for market failures which may result in an
operator being in a position to lessen competition in the industry. The
Commission intends to consult widely amongst stakeholders and the
general public to ensure that all aspects of the dominance issue is
thoroughly examined before a recommendation and eventually a declaration
is made to that effect.
The Commission is therefore inviting submissions from all stakeholders,
identifying specific markets and instances of anti-competitive conducts
to assist the Commission on this project. All submissions should be sent
